- The statute states that any person who willfully violates any
provision of this subsection is guilty of a 2nd degree misdemeanor. A police officer can arrest you for any reason. NEVER argue with an arresting officer or any other law enforcement officer for that matter. Do not resist the officer physically or verbally. You may also be charged with resisting arrest. Save your argument for the judge. If the judge truly believes you were unaware (not willfully) in violation of the law, the judge can then dismiss the charge based on your ignorance. This is one of the few times that "ignorance of the law' may be an excuse.
Be Securely Concealed, Polite, Courteous, and Smartly Sober when carrying. You are rightfully and legally held to a higher standard of conduct when carrying a firearm. Carrying is not for everyone. When in doubt...Don't carry. If you truly believe you're going to need a gun when going some place...AVOID the place!
